If States Indict Trump for a Crime, Can DOJ Rescind His Pardons

That’s an interesting question that our country never faced before with any similar circumstances to ever be able to answer. If States indict Trump for a crime, as it looks like he might in either New York or Georgia, can the Department of Justice rescind his presidential pardons under the legal argument that criminal U.S. Presidents cannot pardon other criminals when they commit their crimes while in Office? We are talking about those who participated in a coup against the U.S. Government, or attempted to overturn the elections knowing President Biden won.

This question will spike the interests of many legal scholars who might find reasons for, or against, such a defining argument.

It certainly is worth exploring if and when Donald Trump faces the justice he deserves.

We all know for a fact that superb jurists are always pushing the boundaries of what the Constitution or laws are meant to accomplish. This, in my opinion, might be the legal question of the decade to answer. Whether in the negative or the positive.

THE INFAMOUS PEOPLE IT MIGHT IMPACT

Let us re-publish the most important names of those Donald Trump pardoned while in office. It’s not hard to see from the list below that ALL deserve to spend the rest of their lives in prison.

  • Michael Flynn (Pardoned on November 20, 2020) — This is the man who believes Donald Trump should have declared martial law to steal the elections. No one can be more dangerous to our democracy.
  • Roger Stone (Pardoned on December 23, 2020) — One of the most despicable people in politics. A hack through and through, Stone will sell his mother for a smile from Trump.
  • Paul Manafort (Pardoned on December 23, 2020) — He is the Russian spy that passed information about our elections to a Russian intelligence officer. Why pardon him? We will all know once the public can peek into Trump’s tax returns.
  • Stephen Bannon (Pardoned on January 19, 2021) — Bannon is openly and defiantly preparing for the next insurrection. He created a list of 20,000 traitor appointees who will help Trump next time succeed with his coup. He is as dangerous as Donald Trump has been.
Let us hope the DOJ, with Merrick Garland leading it, has the temerity to tackle this question if and when New York or Georgia indict Trump.

TENDENCIES OF THE SUPREME COURT

People forget that of the three nominations to the Supreme Court, all are dedicated conservatives who care more about killing abortion rights than serving Donald Trump. Something that Trump himself forgets even more. Why is this so important? Because when dealing with Trump’s personal affairs, the Court has shown a tendency to follow the rules of the law.

One can find the truth in this statement in the Court’s latest refusal to allow the former President to escape the culpability of his role in sparking the insurrection when 8 Justices to only 1 dissented in favor of releasing the White House notes and documents to the January 6 Commission.

On the extreme Texas abortion law, the Supreme Court sided with Texas.

So, if this question of whether a criminal President can pardon other criminals is presented to this Supreme Court, it might produce results to reverse the pardons.

Let us hope the DOJ, with Merrick Garland leading it, has the temerity to tackle this question if and when New York or Georgia indict Trump.

One would imagine it would be a question that Garland himself might find interesting to answer given his jurist background.
